How to use eval or If in depends for panel?

Is there a way to do the following?

 

  <row depends="$resultCount$"<=3>

 

I have a few panels I want to show dynamically based on the results from the above search.

Where the resultCount token is set, create an additional token with an eval element, and use this new token in the depends attribute.
