In the Details page of the Splunk AI Assistant for SPL (Cloud Version), it says "Please do not enter any data that is personally identifiable, confidential, or otherwise sensitive." I would take this to mean it relies on the user not to put confidential information in.
There is also a local version of the AI Assistant app which runs a pre-trained model that can formulate and explain SPL queries. This version does not learn using the input data, and the server it runs on can be isolated from the internet to ensure no customer data leaves the machine.

To be clear, the way I Understand the legal terms of use, only what you input into the AI search is used for training purposes (of the A.I.). Its stored within your cloud stack. This does not share your data contained in the results (pulled from your indexers).
