splunk licensing for high availability

in the event that our splunk server becomes unavailable due to a disaster recovery situation, can we use existing licensing or would we need a new license to start the splunk server in the disaster recovery site?

One license can only be used on a single instance without violating the terms of the license. However, if you kept a copy of the license on the second instance in the event of a disaster, you could add that license to make it the main instance while the other is down. After you've recovered, then you can merge the data using another method after taking the disaster instance down.
